The California Invasion of Privacy Act (“CIPA”) has rapidly become one of the most significant drivers of privacy class action litigation in California. Originally enacted to prevent telephone wiretapping, the statute is now being used to challenge modern website technologies such as chat tools, session replay software, and third-party analytics platforms.

This session will examine the rise of CIPA website litigation and the legal theories plaintiffs are using to argue that routine digital tools constitute unlawful interceptions of consumer communications. The presentation will also discuss the types of technologies most frequently targeted, how courts are beginning to approach these claims, and the practical steps companies should consider to mitigate risk while continuing to use modern customer-engagement tools.
